Question by mcrmyangel: in texas can your car be impounded if a person borrowing it has no license?
my mom was driving my car without a license(stupid yes i know!) she was pulled over they took her to jail and impounded my car. i talked to the officer and asked twice if i could pick up the car and they said no. was this correct? i thought you could arrange to have vehicles picked up in this situation.

it depends on the policy of the department and sometimes it just comes down to officer discretion your lucky in Florida its against the law to allow someone to drive your car when you now there license is suspended

Since you can’t claim the car as stolen then it is evidence of your mother’s crime. You would have to claim it as stolen and then refuse to press charges. But you still have to say at least that she took it without your consent and if you gave it to her, she borrowed it, then they will probable keep it and sell in auction as property ceased in the act of a crime.

Umm yea…they are not going to keep your car as evidence of driving without a license ( I saw nowhere in your statement your mother had a suspended license ). I am assuming you talked to the officer before he had it towed? Generally speaking here we tow the vehicle (if the officer is feeling generous he may let a licensed driver take it away but it is officer discretion). Once it is towed a hold is placed on it saying in your case only a licensed driver can pick it up. Ifit were towed for say no insurance then a hold would be placed to verify insurance before being released.
To sum it up your car will not be indefinately impounded and it certainly will not be sold at auction for letting an unlicensed driver drive it. What you want to do is contact the police department and find out what you need to do to get your car. Also most states do allow the owner of the car to be ticketed for letting an unlicensed driver drive a car.
